Before you can head off and sue TracFone you have to make sure your case qualifies. Small claims courts are a specific type of court and therefore they only take on specific types of cases. What are the limitations?
If your claim doesn’t fall within the limits of your state’s small claims court, you’ll have to arbitrate your claim instead.

Now it’s time to file those forms with your court.
There are very specific steps to be followed during this stage and all other stages and most courts require that you physically come to the courthouse to hand-deliver the documents to the clerk. If you are very lucky you might live in a place where you can send them through the mail or fax but in almost all cases you have to go to court in person to sue TracFone in small claims court.
You also have to pay a filing fee in order to sue TracFone in small claims court. Once that’s paid, or waived if you are a low income plaintiff and your county offers waivers, the clerk will stamp and approve your forms, give you back your copies along with your hearing date.
