1

Can you sue Allegiant Airlines in small claims court? Does you case qualify?

Before you sue Allegiant Airlines in small claims court do you have to make sure your case qualifies. Small claims courts are designed to handle specific types of claims. There are two things you need to pay attention to:

  1. The amount of money: Every small claims court sets a maximum dollar size for the claim you can bring, so a cap on how much compensation you can ask for. In most states it’s either $5000 or $10,000, but it can be as low as $2,500. You can find a list of all 50 states’ monetary limits here.
  2. The type of relief: There are two types of awards that you can seek in a traditional lawsuit – monetary (a dollar value payment) and equitable (any non-monetary request). However, with small claims courts they can usually only grant monetary awards. So, if you want to sue Allegiant Airlines in small claims court because they lost and damaged your luggage, you wouldn’t be able to ask for the physical property but instead the monetary value of the lost luggage and its contents.

If your claim doesn’t fall within the limits of your state’s small claims court, you’ll have to arbitrate your claim instead.

2

Send a demand letter.

The demand letter is just that, a letter where you state what you are demanding they do to fix the problem.

Before you can sue Allegiant Airlines in small claims court, you have to ask them to fix the problem voluntarily. This is done through a demand letter.

Your demand letter can be simple and straightforward – tell Allegiant who you are (your name, address, phone number and account number), what the problem is, and what you want from them. The whole letter can be a few sentences. The point is just to make sure you can check the box for the court before you file paperwork.

When you’re done writing, you need to mail a hard copy of the letter, preferably as certified mail to their legal address. According to our most recent research, Allegiant Airlines is legally based in Nevada and receives mail at this address:

ALLEGIANT AIR, LLC
C/O Laura Overton
1201 N TOWN CENTER DRIVE
Las Vegas, NV 89144
