Taking Rodan + Fields to Small Claims Court Step-by-Step

1

Make sure the case qualifies.

The first thing you need to check is whether your case qualifies for small claims court. Before you can sue Rodan + Fields in small claims court you have to verify two things.

  1. The first is what you want to sue Rodan + Fields for. Small claims courts are designed for specific types of lawsuits and unlike other lawsuits, you can only generally ask for monetary compensation, a dollar amount.
  2. The second limitation is how much money you are suing for. When you sue Rodan + Fields in small claims court depending on your state you will have different monetary limits. You can find a list of all 50 states’ monetary limits here.

If your claim doesn’t fall within the limits of your state’s small claims court, you’ll have to arbitrate your claim instead.

2

Send Rodan + Fields a demand letter.

If your case qualifies it’s time to start writing. The first thing you have to write is your demand letter. Most small claims courts require that you ask the company to fix the problem voluntarily before you sue Rodan + Fields in small claims court.

This letter can be very simple and explain your contact information, what your issue is, perhaps what you’ve already tried to do, and how you want them to fix it going forward.

Send a hard copy once you are done, preferably through certified mail, to their official mailing address. According to our most recent research, Rodan + Fields is legally based in Delaware and receives mail at this address:

Rodan & Fields, LLC
C/O CORPORATION SERVICE COMPANY
251 LITTLE FALLS DRIVE
WILMINGTON, DE 19808

If you would like examples of demand letters or more information about how to write them, you can find an excellent guide here.

The hope is that they will get this letter and respond to it before anyone has to go to court.
3

Fill out court forms.

Of course if they don’t respond, now you fill out the paperwork.

In order to sue Rodan + Fields in small claims court you have to check your state court website to find out which forms are required based on where you live.

Make sure you also print out and fill out enough copies. Most courts require three or four copies.

4

File your complaint forms with the court.

Once your paperwork is filled out it’s time to go to court. This is one of perhaps a few trips you will make and this is here where you officially file your documents with the court to sue Rodan + Fields. To do this, check your website for what days of the week and hours of the day you can deliver the documents. Most courts require that you hand deliver the documents in person.

During this step you will wait in line under the bright fluorescent lights and shuffle across the linoleum until you make your way to the counter where the clerk will take your forms, stamp them, give you back your copies, and assign you a hearing date.

5

“Serve” Rodan + Fields.

This is a long process, but you are nearly there.

Now you have to officially inform the company that they are being served. This is yet another example of postage requirements. There are very specific rules for how you serve a defendant and you have to be careful to follow each rule for where you live.

This is part of the reason you had to fill out so many copies of the court forms. One of those forms goes to the company once it is filed with the court.

Look at your court’s website for instructions on how to properly deliver your forms to Rodan + Fields, or search for “[your state] small claims service of process”. Courts have many strange rules about how to serve a defendant, and your claim will be dropped if you do not follow them perfectly. So be careful!

6

Show up for your hearing.

Once that is all over and done with the only remaining step is to go to your hearing. Your hearing date is already scheduled and should be marked on your calendar.

Don’t forget and to bring your copy of the file to court forms as well as any other evidence you have to back up your case and support why you decided to sue Rodan + Fields in small claims court.
