Some people say it’s hard getting a refund from Cricket.

A lot of customers out there have tried all the Cricket customer service options. Maybe you’ve even tried other ways to bring your Cricket complaint.

But if you haven’t gotten your problem solved, you’re not alone.

So what should you know if you want to sue? First you may think there would be tons of class action lawsuits against Cricket’s parent AT&T to look into. But the truth is more complicated.

Companies like Cricket add what’s called an arbitration clause to their contract. It gives them the right to force legal claims out of most US courts. But your Cricket contract can’t take away your right to sue entirely.

Two ways to Sue Cricket

The first way to sue Cricket is through consumer arbitration. If your contract has an arbitration clause it gives you the right take legal action against Cricket through an officially-designated, independent dispute process that’s not a court and won’t require showing up in person. This can be a better option for a lot of regular people.

The second way to sue Cricket, if you want to avoid the arbitration system, is to use Small Claims Court. While their contract may keep lawsuits out of state and federal courts, they can’t stop you from pursuing the small claims process. If you’re ready to sue Cricket on your own, read on below:

2

Send a demand letter.

Before you can sue Cricket Wireless in small claims court, most courts require you to send a demand letter. The demand letter is an opportunity for the company to fix the problem voluntarily before you sue Cricket Wireless in small claims court.

You have probably reached out to customer service or in some other way tried to resolve the issue but this gets your problem right under the nose of people higher up the food chain.

This letter can be very simple and contain just a paragraph or two that explains your name, your contact information, the problem that you have, what you’ve done up until this point to try and fix it, and how you want the company to now step in and fix it.

When you are done, send a hard copy of the letter through certified mail to the official mailing address. You need to make sure that you mail it in a way that tracks the receipt so that you can prove to the courts that you did this step. Send it to:

Legal Department Notice of Dispute
Cricket
208 S. Akard Office, #2900.13
Dallas, Texas 75202

If you would like examples of demand letters or more information about how to write them, you can find an excellent guide here.

3

Fill out court forms.

At this point when you sue Cricket Wireless in small claims court, you have to fill out a lot of paperwork.

Every court is different in terms of what they require. Find your state court website here.

In addition to filling out the right paperwork, you need to have the right copies. Most courts require you fill out in their entirety three or four copies of everything. If you don’t have the right number of copies they won’t accept your claim.

4

File your court forms.

Now you have to officially file in order to sue Cricket Wireless in small claims court. Take the documents that you have filled out and in most cases and deliver them in person to the court. In some cases you might be able to send them through the mail or online but most courts still require that you do it in person.

When you go to the courthouse a clerk will review the documents, stamp them, give you back your copies, and then assign you a court date after you pay the small claims court filing fee.

5

Serve your court forms on Cricket Wireless.

Even though you’ve done a lot of work so far, there are still a few more steps to follow. This is where you have to serve the company, where you legally inform them that they are being sued.

There are different requirements for how to go about doing this but in essence you are sending them a copy of the forms you got back from the court. Each state has different rules when it comes to the steps you must follow for this process and you can look at your state court website  to find out what you have to do.

Make sure you follow every step no matter how odd it seems. If you don’t, it could cause your case to be thrown out.

6

Show up for court.

When you get your court date from the clerk, after you file your forms, make sure you mark it on your calendar.

When you go to your hearing it’s your opportunity to present your side of the story, any evidence you have, and convince the judge that you were right in deciding to sue Cricket Wireless in small claims court and pursue compensation.

This process could be a very fast and simple one and in some cases the company won’t even send someone to oppose you but in some other cases more complex situations might take weeks to solve.
