The first option for suing DISH Network is through consumer arbitration. Contracts with arbitration clauses give you the right take legal action through an officially-designated, independent dispute process that’s not a court and won’t require showing up in person. This can be a better option for a lot of regular people.
The second way to sue DISH Network, if you want to avoid the arbitration system, is to use Small Claims Court. Because Small Claims Court processes differ from place to place, FairShake can’t help out here. It may require showing up in person and filling out some forms.

Ready to sue DISH Network in small claims court? Make sure you claim qualifies first. Small claims courts are only for certain types of claims, and there are two things you need to pay attention to:
Every small claims court has a maximum dollar size for the claim you can ask for, meaning, there are limits to how much money you can ask for from DISH Network. It can range between $2,500 and upwards of $15,000 but for most states it’s either $5000 or $10,000. You can find a list of all 50 states’ monetary limits here.If your claim doesn’t fall within the limits of your state’s small claims court, you’ll have to arbitrate your claim instead.
Most small claims
courts require you ask the company to fix the problem voluntarily before you sue DISH Network in small claims court.
This is done via a demand letter.
The demand letter does not have to be particularly complicated. You just need to explain your name, address, phone number, account number, what the problem is, and how you want DISH Network to fix it. The whole point is to just check the box and prove to the small claims court that you did this.
When you’re done writing, you need to mail a hard copy of the letter, to their official address. It is best to send it via certified mail so that you can confirm receipt.

In order to
sue DISH Network in small claims court, you’re going to need to fill out some paper work.
Every state is different and requires separate paperwork. And sometimes your county will provide additional forms. Find your state court website here.
Make sure you fill out enough forms – most states that require you to file forms by mail or in-person (see Step 3) will ask for 3 or 4 copies. If you don’t have the correct number of copies, you won’t be able to file your claim.
Almost all courts will require that you physically deliver the papers to the courthouse during specific hours. Other courts might let you get away with filing by mail, fax, or online.
In order to sue DISH Network in small claims court you will have to pay the filing fee, the amount of which should be published on your court website.
When you file your forms, the court clerk will provide you with a stamped copy of the forms and a court date. Keep those documents safe and bring your copy on the day of your hearing.
This is a very long and complicated process and it’s not over yet. One of the copies you get back from the clerk is meant for DISH Network.
Now you have to tell DISH Network that they are being sued, a process called “serving”. in order to do this you have to deliver one copy of your file forms to the company. Again, your court website should have instructions on how to properly deliver forms but you can also search for “[your state] small claims service of process”.
Some courts have very strange rules about how the serving process is to take place and it’s imperative that you follow each and every rule no matter how strange or outdated otherwise your claim could be dropped.
When the court
clerk gives you a court date mark on your calendar.
Make sure you know which courthouse to go to, as many cities have multiple buildings, some far apart from one another. Bring your copy of your filed forms, and any other evidence that backs up why you decided to sue DISH Network in small claims court.
Sometimes, DISH Network will not show up to oppose you, in which case you should take advantage of the situation to focus on your side of the story.
